Medicare Procedure Status & Inpatient-Only Review

Procedure status is date-of-service specific. Review should begin by confirming the applicable CMS procedure-status rule for the year under review, then applying the relevant Medicare patient-status and medical-necessity framework to the documented clinical circumstances.

Procedure status is a Medicare payment and patient-status question—not a shortcut for clinical judgment. Physician review identifies the current-year CMS status of the procedure, then applies the appropriate Medicare framework to the individual patient.

IPO status can establish an inpatient payment pathway.Removal from the IPO list does not mean inpatient admission is prohibited or that observation is automatically required.
THE FIRST QUESTION

Is the procedure on the current Medicare Inpatient-Only list?

The answer determines which patient-status pathway applies. CMS updates procedure classifications through annual OPPS rulemaking, so the current calendar-year source matters.

ON IPO LIST

Medicare designates the procedure as inpatient-only

For Medicare payment under the OPPS framework, inpatient-only services are generally not paid when furnished as hospital outpatient services.

Review implicationThe IPO designation provides the applicable inpatient-status pathway, subject to Medicare rules and limited exceptions.
NOT ON IPO LIST

Do not automatically default to observation

A procedure that is not on the IPO list may be payable in an outpatient setting when clinically appropriate—but it may also be appropriately furnished during an inpatient admission.

Review implicationApply the Two-Midnight benchmark, case-by-case inpatient exception when applicable, and the documented clinical circumstances.
COMMON STATUS ERROR

“Not IPO” does not mean “must be outpatient.”

Removal from the IPO list means the procedure is no longer restricted to inpatient payment under that list. It does not erase the Medicare inpatient-admission framework or the physician's responsibility to determine the clinically appropriate setting.

CY 2026 POLICY CHANGE

CMS has restarted a three-year phase-out of the IPO list.

For calendar year 2026, CMS removed 285 mostly musculoskeletal procedures from the Inpatient-Only list. CMS states that this permits Medicare payment in the hospital outpatient setting when clinically appropriate and gives physicians greater flexibility in selecting the appropriate site of service.

CMS describes the first phase as consisting primarily of musculoskeletal services.

3

Year phase-out

The CY 2026 final rule begins a new phased elimination of the IPO list over three years.

↔

More site-of-service flexibility

Removal allows outpatient payment when appropriate while preserving inpatient payment when the patient's clinical circumstances support inpatient admission.

Transitional medical-review protection also matters.

CMS continued an exemption from certain Two-Midnight medical-review activities for procedures removed from the IPO list, until CMS determines the procedure is more commonly performed in the Medicare population in the outpatient setting. This is a review-policy protection; it is not a declaration that every such case is medically necessary as inpatient.

PHYSICIAN-ADVISOR WORKFLOW

Procedure status is only the beginning of the determination.

A defensible review separates the procedure's CMS classification from the patient's clinical need for inpatient hospital care.

1

Identify the exact procedure

Confirm the CPT/HCPCS procedure and the relevant calendar year.

2

Verify current CMS status

Determine whether the procedure is currently IPO, was recently removed, or is otherwise payable under OPPS.

3

Apply the status framework

If not IPO, evaluate the Two-Midnight benchmark and any applicable case-by-case inpatient pathway rather than assuming observation.

4

Assess patient-specific risk

Consider comorbidities, severity, anticipated postoperative needs, complications, current medical needs, and adverse-event risk documented in the record.

5

Document the determination

Explain why the procedure status and patient-specific clinical circumstances support the selected level and site of care.

ILLUSTRATIVE STATUS REVIEW

Major orthopedic procedure removed from IPO

An older patient with substantial comorbidity presents for a procedure that CMS has removed from the Inpatient-Only list. The fact that outpatient payment is now permitted does not resolve patient status.

The physician reviewer assesses the anticipated hospital course, severity and comorbidities, perioperative risks, current medical needs, and expected postoperative monitoring. If the record supports a reasonable expectation of medically necessary hospital care spanning at least two midnights—or another applicable Medicare inpatient pathway—the admission may still be appropriate as inpatient.

CURRENT-SOURCE PRINCIPLE

Never rely on a static historical IPO list.

CMS changes procedure classifications through annual rulemaking and related OPPS files. Verify the procedure's current-year status and any applicable transition policy at the time of review.

CY 2026 CMS UPDATE

The Medicare Inpatient-Only list is being phased out.

For CY 2026, CMS began a three-year phase-out of the Inpatient-Only list by removing 285 procedures, primarily musculoskeletal services. Procedure status therefore must be verified against the Medicare rules applicable to the date of service.

Removal from the Inpatient-Only list does not by itself establish that outpatient care is clinically appropriate. The applicable Medicare patient-status framework, expected hospital course, medical necessity, and patient-specific clinical circumstances still require review.
